Do you need a permit for a gazebo?

From state residential codes and town building departments, checked November 2026. This isn't legal advice; your building department decides.

Short answer

Often not, if it's 200 sq ft or less: a 12x14 gazebo is 168 sq ft. Many residential codes exempt one-story detached structures up to 200 sq ft. But some towns want a permit for any gazebo, most still enforce setbacks, and wiring always needs its own permit.

What we found

WhereRule
Ohio Residential Code §102.10No approval needed for "one-story detached accessory structures used as tool and storage sheds, playhouses and similar uses" up to 200 sq ft; the work must still meet the code
Minnesota Rule 1300.0120Same 200 sq ft exemption; exemptions "do not authorize work to be done in any manner in violation of the code"
Maplewood, MN"Gazebos and pergolas which are larger than 200 square feet require a building permit"; electrical needs its own permit
Maryland Heights, MOGazebos of 200 sq ft or less still need a free permit and a site plan; larger ones a building permit
Lady Lake, FLA permit for any detached structure, including a gazebo; prefabricated ones need the anchoring diagram
Goose Creek, SCNo permit up to 200 sq ft, but in its 140+ mph wind zone every accessory structure must be anchored

Exempt doesn't mean anything goes

Both Ohio's and Minnesota's exemptions say the work must still meet the code. That includes the snow load: Ohio's code requires structures to "safely support all loads, including … snow loads," and Minnesota sets a ground snow load of 50 or 60 psf by county. Many kit gazebos are rated far below that, so plan to clear them; the snow load check shows how deep you can let it get.

Before you build

  • Ask about setbacks: Lady Lake, FL wants 10 ft from the rear line for small structures; Maplewood, MN wants distances on a site plan.
  • Check your HOA, which can be stricter than the town.
  • Anchor it the way the manual says. Wind ratings assume it.
  • Call 811 before digging footings.
