Terms of use

1. Acceptance of these terms

These terms govern your use of Spec My Yard and its sister sites, Spec My House, Spec My Garage, Spec My Yard and Spec My Kitchen (together, the “Sites”), including every calculator, guide, chart, drawing, plan and other content on them (the “Content”). “We”, “us” and “our” mean Rorz Network LLC, which operates the Sites. By using the Sites you agree to these terms. If you do not agree, do not use the Sites.

2. Information only, not professional advice

The Content is provided for general informational purposes only. It is not engineering, structural, electrical, plumbing, mechanical, building code, legal, financial, medical or any other professional advice, and it is no substitute for such advice. Results are estimates based on the inputs you provide, on published figures that may be incomplete, out of date or wrong, and on simplifying assumptions that may not fit your situation. Nothing on the Sites creates a professional or advisory relationship between you and us.

Before relying on any Content, you are responsible for verifying it independently, including against the manufacturer's current specifications and installation instructions, the codes and permits that apply where you live, and the advice of a licensed professional. Where the Content differs from a manufacturer's instructions or your local code, those govern.

3. Use at your own risk

Your use of the Sites and the Content, and any decision or action you take based on them, is entirely at your own risk. You assume all risk of personal injury, death, property damage, financial loss, code violations, voided warranties and any other loss or harm arising from or related to your use of, or reliance on, the Sites or the Content.

4. No warranty

THE SITES AND THE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTIES OF ACCURACY, COMPLETENESS, RELIABILITY, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY RESULT IS CORRECT, THAT THE SITES WILL BE AVAILABLE, UNINTERRUPTED OR ERROR-FREE, OR THAT ANY ERROR WILL BE CORRECTED.

5. No liability, and its limits

TO THE FULLEST EXTENT PERMITTED BY LAW, WE HAVE NO LIABILITY TO YOU OR TO ANYONE ELSE FOR ANY CLAIM, LOSS OR DAMAGE OF ANY KIND ARISING FROM OR RELATED TO YOUR USE OF, OR RELIANCE ON, THE SITES OR THE CONTENT, INCLUDING ANY CALCULATION, PLAN, DRAWING, CUT LIST, CHART OR PRODUCT INFORMATION, AND ANY PROJECT, PURCHASE OR INSTALLATION YOU UNDERTAKE BASED ON THEM.

WITHOUT LIMITING THE ABOVE, AND TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE, OR OUR OWNERS, CONTRACTORS, SUPPLIERS OR LICENSORS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF PROFITS, DATA, USE OR GOODWILL, OR COST OF SUBSTITUTE GOODS OR SERVICES, ARISING FROM OR RELATED TO THE SITES OR THE CONTENT, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IF, DESPITE THE ABOVE, WE ARE FOUND LIABLE TO YOU, THEN TO THE FULLEST EXTENT PERMITTED BY LAW OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITES OR THE CONTENT WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

Some laws, including California Civil Code section 1668, do not allow a party to exclude liability for its own fraud, willful injury or violation of law, and some jurisdictions do not allow the exclusion of certain warranties or damages. Nothing in these terms excludes liability that cannot lawfully be excluded; in those cases our liability is limited to the smallest amount the law allows.

6. Indemnity

You agree to defend, indemnify and hold harmless us and our owners, contractors, suppliers and licensors from any claims, losses, damages, liabilities, costs and expenses (including reasonable attorneys' fees) arising from or related to your use of the Sites or the Content, any project you carry out using them, or your breach of these terms.

7. Products, third parties and links

Product names, dimensions, ratings and other data come from manufacturers, standards bodies, government agencies and other third parties. Products change without notice, and we do not guarantee that any product will fit, perform or be suitable as described. Mention of a product or brand is not an endorsement, and brand names belong to their owners.

The Sites link to websites we do not control, including retailers. We are not responsible for their content, products, prices or practices, and your dealings with them are solely between you and them. As an Amazon Associate we earn from qualifying purchases; that never changes a calculator's result.

8. Permitted use

You may use the Sites and print the Content for your own personal, non-commercial use. You may not copy, republish, sell or scrape the Content in bulk, interfere with the Sites' operation, or use them for any unlawful purpose. All rights not expressly granted are reserved.

9. Privacy

Our privacy page explains what we collect and why. By using the Sites you agree to it.

10. Changes and general terms

We may change the Sites, the Content or these terms at any time without notice. The date at the top shows the latest version, and continued use after a change means you accept it. If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce any part is not a waiver. These terms are the entire agreement between you and us about the Sites.

11. Governing law and where disputes are heard

These terms, and any dispute arising from or related to them or to the Sites, are governed by the laws of the State of California, without regard to its conflict-of-law rules. You agree that any such dispute will be brought only in the state or federal courts located in California, and you consent to their personal jurisdiction.
