Pool fence requirements

From the U.S. Consumer Product Safety Commission's Safety Barrier Guidelines for Residential Pools (Pub. 362, April 2023). Your local code has the final say and may be stricter.

Short answer

At least 48 in tall, no gap over 4 in at the bottom, no opening a 4 in ball can pass, and gates that open away from the pool, close and latch by themselves, with the latch out of a child's reach. Some places require 60 in.

Checklist

Height"The top of the barrier should be at least 48 inches above the surface." Some states, counties and towns require 60 inches.
Gap at the bottomNo more than 4 in over a solid surface, 2 in over grass or gravel, 1 in under a removable mesh fence.
Openings"Openings in the barrier should not allow passage of a 4-inch diameter sphere."
Horizontal railsIf they're less than 45 in apart, put them on the pool side so they can't be climbed, and keep vertical pickets 1¾ in apart or less.
Chain linkMesh no bigger than 1¼ in square, unless slats bring the openings down to 1¾ in. Lattice openings 1¾ in or less.
GatesOpen outward, away from the pool, self-closing and self-latching. If the latch release is under 54 in from the bottom of the gate, it goes on the pool side at least 3 in below the top, with no opening over ½ in within 18 in of it.
House as one sideDoors to the pool area need an alarm (UL 2017) that sounds for at least 30 seconds, at least 85 dB at 10 ft, with a reset at least 54 in up; or a power safety cover meeting ASTM F1346-91.
Above-ground poolsWhere a barrier sits on top of the pool wall, the gap between them should be 4 in or less.

The guidelines are recommendations; states and towns write the actual rules. Ask your building department before you build.
